3.3 Shopify Network Intelligence and improved services

Our shop is hosted by Shopify. Shopify processes personal data when you visit our shop and make purchases. Shopify Network Intelligence is enabled. Shopify can aggregate information about your interactions with our shop, with other merchants, and with Shopify to provide improved services. This may include personalized shopping experiences, analysis of the use of our shop and our advertising, fraud prevention, and relevant advertising.

Depending on usage, contact and order data, device and usage information (e.g., IP address, browser, cookie identifiers, pages visited, search queries, products viewed, and shopping cart contents) are processed in particular. This information is shared with Shopify and, if applicable, other service providers who may also be based in other countries. Shopify acts as an independent controller for certain improved services. Information on recipients and international transfers can be found in the Shopify Privacy Policy for Consumers and the general privacy policy linked therein.

Processing required for operation and contract fulfillment is based on Art. 6 (1) (b) GDPR; necessary security and fraud prevention measures are based on Art. 6 (1) (f) GDPR. Analysis, non-essential cookies, and personalized advertising requiring consent are only used with your consent (Art. 6 (1) (a) GDPR). You can withdraw consent via the cookie settings. You can also exercise your rights against Shopify, including withdrawal, objection, deletion, and restriction, via the Shopify Privacy Portal. The withdrawal does not affect the legality of processing that took place until that point.

4) Cookies

To make visiting our website attractive and to enable the use of certain functions, we use cookies, which are small text files placed on your device. Some of these cookies are automatically deleted after closing the browser (so-called "session cookies"), while others remain on your device for a longer period and allow the saving of page settings (so-called "persistent cookies"). In the latter case, you can find the storage duration in the overview of your web browser's cookie settings.

Insofar as personal data is also processed by individual cookies used by us, the processing is carried out in accordance with Art. 6 (1) (b) GDPR either for the performance of the contract, in accordance with Art. 6 (1) (a) GDPR in the case of consent given, or in accordance with Art. 6 (1) (f) GDPR to protect our legitimate interests in the best possible functionality of the website as well as a customer-friendly and effective design of the site visit.

You can set your browser so that you are informed about the setting of cookies and decide individually on their acceptance or exclude the acceptance of cookies for certain cases or generally.

Please note that if cookies are not accepted, the functionality of our website may be limited.

5) Contacting us

As part of contacting us (e.g., via contact form or e-mail), personal data is processed—exclusively for the purpose of processing and answering your request and only to the extent necessary.

The legal basis for the processing of this data is our legitimate interest in answering your request in accordance with Art. 6 (1) (f) GDPR. If your contact is aimed at a contract, an additional legal basis for the processing is Art. 6 (1) (b) GDPR. Your data will be deleted when the circumstances indicate that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

6) Data processing for order processing

6.1 As far as necessary for the performance of the contract for delivery and payment purposes, the personal data collected by us will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 (1) (b) GDPR.

If we owe you updates for goods with digital elements or for digital products on the basis of a corresponding contract, we process the contact data provided by you when ordering in order to inform you personally within the framework of our legal information obligations in accordance with Art. 6 (1) (c) GDPR. Your contact data will be used strictly for the purpose of communicating about updates owed by us and will only be processed by us for this purpose to the extent necessary for the respective information.

6.2 Disclosure to fulfillment and shipping service providers

For the processing, packaging, and shipment of your order, we transmit the necessary order and delivery data (name, delivery address, and ordered items) to our commissioned fulfillment service provider in the Netherlands and to the DHL shipping service provider commissioned for delivery. Processing is carried out for the fulfillment of the contract according to Art. 6 (1) (b) GDPR.

We pass on your e-mail address and/or telephone number to the shipping service provider for delivery announcements or coordination of delivery if you have expressly consented to this (Art. 6 (1) (a) GDPR). You can withdraw this consent at any time with effect for the future towards us or the shipping service provider.

6.3 Use of payment service providers (payment services)

Shopify Payments and Shop Pay

Payment processing is carried out via Shopify Payments and the payment service providers used for the selected payment method. For this purpose, the contact, order, transaction, and payment data required for payment are processed in accordance with Art. 6 (1) (b) GDPR. When using Shop Pay, Shopify also processes the data required for accelerated checkout. Further information can be found in the Shopify Privacy Policy for Consumers.

The available payment methods are displayed in the checkout. These include credit and debit cards, Shop Pay, Apple Pay, Google Pay, and, depending on the delivery country and eligibility, Klarna, Bancontact, and MobilePay. For Bancontact and MobilePay, the information required for payment processing is transmitted to the service providers named in the respective payment transaction (Art. 6 (1) (b) GDPR).

- Apple Pay

If you opt for the "Apple Pay" payment method from Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, payment processing is carried out via the "Apple Pay" function on your device running iOS, watchOS, or macOS by charging a payment card stored in "Apple Pay." Apple Pay uses security features integrated into your device's hardware and software to protect your transactions. To authorize a payment, it is therefore necessary to enter a code previously set by you and to verify using the "Face ID" or "Touch ID" function of your device.

For the purpose of payment processing, your information provided during the ordering process, along with information about your order, is transmitted to Apple in encrypted form. Apple then encrypts this data again with a developer-specific key before the data is transmitted to the payment service provider of the payment card stored in Apple Pay for the execution of the payment. The encryption ensures that only the website via which the purchase was made can access the payment data. After the payment has been made, Apple sends your device account number and a transaction-specific, dynamic security code to the original website to confirm successful payment.

Insofar as personal data is processed during the described transmissions, the processing is carried out exclusively for the purpose of payment processing in accordance with Art. 6 (1) (b) GDPR.

Apple retains anonymized transaction data, including the approximate purchase amount, approximate date and time, and whether the transaction was completed successfully. The anonymization completely excludes any personal reference. Apple uses the anonymized data to improve "Apple Pay" and other Apple products and services.

If you use Apple Pay on an iPhone or Apple Watch to complete a purchase made via Safari on a Mac, the Mac and the authorization device communicate via an encrypted channel on Apple's servers. Apple does not process or store any of this information in a format that can identify you. You can disable the ability to use Apple Pay on your Mac in your iPhone settings. Go to "Wallet & Apple Pay" and turn off "Allow Payments on Mac."

Further information on data protection with Apple Pay can be found at the following internet address: https://support.apple.com/de-de/HT203027
- Google Pay

If you opt for the "Google Pay" payment method from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"), payment processing is carried out via the payment method stored in your Google account.
To authorize a payment via Google Pay on a desktop, you must first log in to your Google account; for authorization on a mobile device, you must complete the corresponding verification procedure (e.g., via face recognition, password, fingerprint, or pattern).

For the purpose of payment processing, your information provided during the ordering process, along with information about your order, is transmitted to Google. Google then transmits your payment information stored in Google Pay in the form of a one-time transaction number to the original website, which verifies that payment has been made. This transaction number does not contain any information about the real payment data of your payment methods stored in Google Pay, but is created and transmitted as a one-time valid numeric token. In all transactions via Google Pay, Google acts solely as an intermediary for processing the payment process. The execution of the transaction takes place exclusively in the relationship between the user and the original website by charging the payment method stored in Google Pay.

Insofar as personal data is processed during the described transmissions, the processing is carried out exclusively for the purpose of payment processing in accordance with Art. 6 (1) (b) GDPR.

Google reserves the right to collect, store, and evaluate certain transaction-specific information for every transaction made via Google Pay. This includes the date, time, and amount of the transaction, merchant location and description, a description of the purchased goods or services provided by the merchant, photos you have attached to the transaction, the name and e-mail address of the seller and buyer or the sender and recipient, the payment method used, your description of the reason for the transaction, and, if applicable, the offer associated with the transaction.

According to Google, this processing is carried out exclusively in accordance with Art. 6 (1) (f) GDPR on the basis of the legitimate interest in proper accounting, verification of transaction data, and optimization and maintenance of the functionality of the Google Pay service.

Google also reserves the right to combine the processed transaction data with other information collected and stored by Google when using other Google services.

- Klarna

One or more online payment methods from the following provider are available on this website: Klarna Bank AB, Sveavägen 46, 111 34 Stockholm, Sweden

If you select a payment method from the provider where you make an advance payment (e.g., credit card payment), your payment data provided during the ordering process (including name, address, bank and payment card information, currency, and transaction number) as well as information about the content of your order will be transmitted to the provider in accordance with Art. 6 (1) (b) GDPR. In this case, your data will be passed on exclusively for the purpose of payment processing with the provider and only to the extent necessary for this purpose.

If you select a payment method where the provider makes an advance payment (e.g., invoice or installment purchase or direct debit), you will also be asked to provide certain personal data (first and last name, street, house number, zip code, city, date of birth, e-mail address, telephone number, and, if applicable, data on an alternative payment method) during the ordering process.

To safeguard our legitimate interest in determining the creditworthiness of our customers, this data is forwarded by us to the provider for the purpose of a credit check in accordance with Art. 6 (1) (f) GDPR. Based on the personal data you provide as well as other data (such as shopping cart, invoice amount, order history, payment experience), the provider checks whether the payment method you have selected can be granted with regard to payment and/or default risks.

For the decision-making process during the application review, in addition to internal criteria of the provider, identity and creditworthiness information from the following credit agencies may also be included in accordance with Art. 6 (1) (f) GDPR:

https://cdn.klarna.com/1.0/shared/content/legal/terms/0/de_de/credit_rating_agencies

The credit report may contain probability values (so-called score values). Insofar as score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical method. The calculation of the score values includes, among other things, but not exclusively, address data.

You can object to this processing of your data at any time by sending us a message or by contacting the provider. However, the provider may remain entitled to process your personal data if this is necessary for contractual payment processing.

6.4 Electronic withdrawal function for distance contracts

Consumers who conclude contracts on this website for which a statutory right of withdrawal exists have the option of declaring their withdrawal via an electronic withdrawal function in accordance with the applicable withdrawal provisions.

When using the withdrawal function, in addition to information identifying the contract to be withdrawn, further personal information such as the consumer's first and last name and email address must be provided or confirmed.

The collection of this information and its transmission to us takes place in accordance with Art. 6 (1) (b) GDPR and only to the extent that it is necessary for the proper processing of the withdrawal. The personal data provided is also used on the basis of Art. 6 (1) (b) GDPR to confirm receipt of the withdrawal declaration by email. A further legal basis for processing is Art. 6 (1) (c) GDPR. We are legally obliged to provide an electronic withdrawal function for consumer distance contracts involving payment.

7) Tools and miscellaneous

7.1 easybill

For bookkeeping purposes, we use the service of the cloud-based accounting software from the following provider: easybill GmbH, Düsselstr. 21, 41564 Kaarst

The provider processes incoming and outgoing invoices as well as, if applicable, the bank transactions of our company in order to automatically record invoices, match them to transactions, and create financial accounting from this in a semi-automated process.

Insofar as personal data is processed in this context, the processing is based on our legitimate interest in the efficient organization and documentation of our business processes in accordance with Art. 6 (1) (f) GDPR.

7.2 Cookie Consent Tool

This website uses a so-called "cookie consent tool" to obtain effective user consent for cookies and cookie-based applications that require consent. The "cookie consent tool" is displayed to users when they visit the page in the form of an interactive user interface, on which consent for specific cookies and/or cookie-based applications can be given by checking a box. Through the use of the tool, all cookies/services requiring consent are only loaded if the respective user gives the corresponding consent by checking the box. This ensures that such cookies are only placed on the user's respective terminal device if consent has been given.

The tool places technically necessary cookies to save your cookie preferences. Data required for storing and proving your consent decision may be processed.

If, in individual cases, personal data (such as the IP address) is processed for the purpose of storing, assigning, or logging cookie settings, this is done in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in legally compliant, user-specific, and user-friendly consent management for cookies and, therefore, in a legally compliant design of our website.

A further legal basis for processing is Art. 6 (1) (c) GDPR. As the controller, we are subject to the legal obligation to make the use of technically unnecessary cookies dependent on the respective user consent.

Where necessary, we have concluded a data processing agreement with the provider, which ensures the protection of our site visitors' data and prohibits unauthorized disclosure to third parties.

Further information on the operator and the setting options of the cookie consent tool can be found directly in the corresponding user interface on our website.

8) Rights of the data subject

8.1 The applicable data protection law grants you the following data subject rights (information and intervention rights) vis-à-vis the controller with regard to the processing of your personal data, whereby reference is made to the stated legal basis for the respective requirements for exercise:

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, FURTHER PROCESSING REMAINS RESERVED IF WE CAN PROVE COMPELLING LEGITIMATE GROUNDS FOR PROCESSING THAT OUTWEIGH YOUR INTERESTS, FUNDAMENTAL RIGHTS, AND FUNDAMENTAL FREEDOMS, OR IF THE PROCESSING SERVES TO ASSERT, EXERCISE, OR DEFEND LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING. YOU CAN EXERCISE THE OBJECTION AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

9) Duration of storage of personal data

The duration of the storage of personal data is determined by the respective legal basis, the purpose of processing, and – if applicable – additionally by the respective statutory retention period (e.g., commercial and tax retention periods).

When processing personal data on the basis of explicit consent pursuant to Art. 6 (1) (a) GDPR, the data concerned is stored until you revoke your consent.

If there are statutory retention periods for data that is processed within the framework of legal or quasi-legal obligations on the basis of Art. 6 (1) (b) GDPR, this data is routinely deleted after the expiry of the retention periods, provided it is no longer required for the performance of the contract or the initiation of the contract and/or we have no legitimate interest in continuing to store it.

When processing personal data on the basis of Art. 6 (1) (f) GDPR, this data is stored until you exercise your right to object pursuant to Art. 21 (1) GDPR, unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms, or the processing serves to assert, exercise, or defend legal claims.

When processing personal data for the purpose of direct marketing on the basis of Art. 6 (1) (f) GDPR, this data is stored until you exercise your right to object pursuant to Art. 21 (2) GDPR.

Unless otherwise stated in the other information of this declaration regarding specific processing situations, stored personal data is otherwise deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
